Senator Ihlenfeld moved to amend the bill on page one, after the enacting clause, by inserting the following:

CHAPTER 7. COUNTY COMMISSIONS AND OFFICERS

ARTICLE 26. WEST VIRGINIA SHERIFFS' BUREAU OF PROFESSIONAL STANDARDS.

§7-26-2. General powers and duties; legislative rules.

(a) The bureau shall have the power to contract and be contracted with relating to training and operation of state sheriff offices. The bureau may recommend policies and procedures to sheriff offices, including, but not limited to, those that promote cooperation between all state and local law-enforcement officers, eliminate duplication of work, promote the proper and efficient operation of the office of the sheriff and which seek to standardize operation of sheriff offices throughout the state. The bureau may propose legislative rules which adopt a standard badge, uniform and color for the motor vehicles used by the various sheriffs and deputy sheriffs of West Virginia.

(b) There is hereby created in the State Treasury a special revenue account to be known as the "West Virginia Sheriff’s Personal Body Armor Acquisition Fund." The fund authorized by this subsection may receive any gifts, grants, contributions or other money from any source which is specifically designated for deposit in the fund.

(c) In addition to the powers conferred upon the bureau pursuant to this article, it may make grants and provide technical services to assist in the purchase personal body armor described in subsection (a) of §7-7-14a of this code.

(d) Nothing in this section may be construed to mandate funding for the West Virginia Sheriff’s Personal Body Armor Acquisition Fund or to require any appropriation by the Legislature.

CHAPTER 61. CRIMES AND THEIR PUNISHMENT.;

            On page one, section four, lines one through eight, by striking out all of subsection (a) and inserting in lieu thereof a new subsection, designated subsection (a). to read as follows:


(a) Except as provided in §61-7-4(h) of this code, any person a resident of this state desiring to obtain a state license to carry a concealed deadly weapon shall apply to the sheriff of his or her county for the license, and pay to the sheriff, at the time of application, a fee of $75 $25. A person who is not a resident of this state desiring to obtain a state license to carry a concealed deadly weapon shall apply to the sheriff of any county for the license, and pay to the sheriff, at the time of application, a fee of $75, of which $15 of that amount shall be deposited in the Courthouse Facilities Improvement Fund created by §29-26-6 of this code and $35 of that amount shall be deposited in West Virginia Sheriff’s Personal Body Armor Acquisition Fund created by §7-26-6 of this code. Concealed weapons license may only be issued for pistols and revolvers. Each applicant shall file with the sheriff a complete application, as prepared by the Superintendent of the West Virginia State Police, in writing, duly verified, which sets forth only the following licensing requirements:;

(a) Any person who is at least eighteen years of age and less than twenty-one years of age who desires to obtain a state license to carry a concealed deadly weapon shall apply to the sheriff of his or her county for a provisional license, and pay to the sheriff, at the time of application, a fee of $25, $15. A person who is not a resident of this state desiring to obtain a state license to carry a concealed deadly weapon shall apply to the sheriff of any county for the license, and pay to the sheriff, at the time of application, a fee of $25, of which $5 of that amount shall be deposited in the Courthouse Facilities Improvement Fund created by §29-26-6 of this code and $5 of that amount shall be deposited in West Virginia Sheriff’s Personal Body Armor Acquisition Fund created by §7-26-6 of this code. Provisional licenses may only be issued for pistols or revolvers. Each applicant shall file with the sheriff a complete application, as prepared by the Superintendent of the West Virginia State Police, in writing, duly verified, which sets forth only the following licensing requirements.
